Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cascade mobile application (the "App," "Service"), operated by Bumbler Interactive LLC ("we," "us," or "our").

By creating an account or using Cascade, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Cascade. By using the App, you represent that you meet this requirement.

2. Accounts

• You must create an account (via email or a supported sign-in provider) to use Cascade.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate information when creating your account and to keep it up to date.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payment

3.1 Free and Paid Tiers

Cascade offers a free tier and one or more paid subscription tiers with additional features.

3.2 Billing

• Paid subscriptions are billed through the Apple App Store (via Apple In-App Purchase) or the Google Play Store (via Google Play Billing), and by subscribing you also agree to that provider's terms of sale.
• If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. You will be charged the price shown for your selected plan at that time.
• Subscriptions automatically renew unless canceled before the end of the current billing period.
• You can manage or cancel your subscription through your App Store or Play Store account settings.

3.3 Refunds

Refunds are handled according to the policies of the platform through which you purchased your subscription (Apple, Google, or our payment processor), except where required otherwise by law.

3.4 Price Changes

We may change subscription pricing. We will provide notice before any price increase takes effect for existing subscribers.

4. Acceptable Use

You agree not to: - Use Cascade for any unlawful purpose - Attempt to reverse-engineer, decompile, or extract source code from the App, except as permitted by law - Interfere with or disrupt the App's servers or networks - Use automated means (bots, scrapers) to access the App without our permission - Upload content that is unlawful, harassing, or infringes on others' rights

We reserve the right to suspend or terminate access for violations of this section.

5. User Content

5.1 Ownership

You retain ownership of the content you create in Cascade, including your habits, checklists, and journal entries ("User Content").

5.2 License to Us

By using the App, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of operating and providing the Service to you (e.g., syncing across your devices).

5.3 Your Responsibility

You are solely responsible for your User Content. We do not claim ownership over it and do not use it for purposes beyond operating the App, as described in our Privacy Policy.

6. Intellectual Property

The App itself — including its design, features, branding, and underlying code (excluding your User Content) — is owned by Bumbler Interactive LLC and protected by intellectual property laws. You may not copy, modify, or distribute the App without our permission.

7. Termination

• You may delete your account at any time through the App's settings.
• We may suspend or terminate your account if you violate these Terms, or if required by law.
• Upon termination, your right to use the App ends immediately. Data deletion following account termination is handled as described in our Privacy Policy.

8. Disclaimers

Cascade is a personal productivity and habit-tracking tool. It is not a substitute for professional medical, psychological, or financial advice. Any journaling or reflection features are provided for personal use only.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUMBLER INTERACTIVE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (OR $50 IF YOU HAVE NOT MADE ANY PAYMENTS).

10. Changes to the App or These Terms

We may modify or discontinue features of the App at any time. We may also update these Terms; material changes will be communicated via the App or email, and continued use after such changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Idaho, United States, without regard to conflict-of-law principles.
